Terms of Use

Too Much Stupid, LLC (TMS) provides the My Pic Wins! site (MPW) to you subject to the following Terms of Use, which may be updated and any time without notice.  Use of MPW is also subject to any terms contained within its Privacy Policy, User Rewards Policy, and Intellectual Property Policy.

When using MPW, you agree to make no attempts at falsifying votes.  This including creating multiple accounts using different e-mail addresses in order to vote multiple times within the same match.  You are allowed to create and operate only one account on MPW.

When creating and using an account, you agree to provide true and accurate information about yourself.  You agree to provide an accurate birthday in order for MPW to verify age requirements.

When submitting pictures, you agree to the following conditions: you are at least 18 years of age; you are at least 18 years of age in each picture you upload; the picture is your property, meaning you took the picture yourself and/or you own its copyright; you must appear in every picture you submit; if any other people appear in a picture, they must be at least 18 years of age and you must have their permission to submit the picture to MPW; the picture is not a professional or studio photograph (only personal/amateur pictures are allowed); the picture is not digitally altered (filters, effects, etc.); the picture does not contain nudity; the picture does not contain any drug paraphernalia; the picture does not contain any middle finger gestures; you will not upload and submit the same picture more than once.  Once a picture has been entered into a match, you can no longer delete it from the site.  If you provide permission to use your picture for TMS and/or MPW materials and/or advertisements, your consent is purely a gesture of goodwill and TMS retains the rights to use your picture within its materials and/or advertisements without any obligation or entitlement of compensation or reimbursement of any kind under any circumstances.

TMS may immediately terminate your account and access to MPW or remove your picture(s) for any reason, including (but not limited to): a request by you; extended periods of inactivity; breaches or violations of the Terms of Use; requests by law enforcement or other government agencies; unexpected technical or security issues or problems; or engagement by you of illegal or fraudulent activities.

By submitting ideas, suggestions, documents, and/or proposals to TMS, you acknowledge and agree that your contributions do not contain confidential or proprietary information, TMS is not under any obligation of confidentiality, express or implied, with respect to the contributions, TMS shall be entitled to use or disclose (or choose not to use or disclose) such contributions for any purpose, in any way, in any media worldwide, TMS may have something similar to the contributions already under consideration or in development, your contributions automatically become the property of TMS without any obligation of TMS to you, and you are not entitled to any compensation or reimbursement of any kind from TMS under any circumstances.

You agree to indemnify and hold TMS and its employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, transmit or otherwise make available through MPW, your use of MPW, your connection to MPW, your violation of the Terms of Use, or your violation of any rights of another.

You expressly understand and agree that: your use of MPW is at your sole risk; MPW is provided on an "as is" and "as available" basis; TMS makes no guarantee that MPW will meet your requirements or expectations, be timely, secure, or error-free; any material downloaded or otherwise obtained through MPW is at your own discretion and risk.  You also expressly understand and agree that Too Much Stupid, LLC and its employees shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including (but not limited to) damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or inability to use MPW, unauthorized access to or alteration of your transmissions or data, statements or conduct or any third party on MPW, or any other matter relating to MPW.  (Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages.  Accordingly, some of the preceding limitations may not apply to you.)
